JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 The present application has been filed for modification of the order dated 14.11.2014 passed in Criminal Miscellaneous No.23057/14 for modification of the condition which stipulates that the petitioner will remain physically present before the court below on each and every date at least for two years or till disposal of the case whichever is earlier and in case of default on two consecutive occasions without reasonable cause, the liberty shall be deemed to be cancelled.

It is submitted that petitioner has appeared regularly till the date and the bail bond has not been cancelled. Considering the petitioner being employed outside the state, let the condition is modified to the extent that the learned court below will cancel the bail bonds of the petitioner on three consecutive defaults during trial.

The order dated 14.11.2014 stands modified to the extent indicated above.

Patna High Court Cr.Misc. No.44416 of 2015 (2) dt.09-12-2015 2/2 Accordingly, the modification application is disposed of in connection with Kashichak P.S. Case No.91 of 2013, pending before learned CJM, Nawada.
