====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-09-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in case registered for the offences punishable under Section 3 of Railway Property (Unlawful Possession) Act and Section 147 of the Railway Act.

3. On secret information of theft, a raid was conducted at Mukhtapur Railway Station and one co-accused Sonu Kumar was apprehended on the spot who disclosed the name of this petitioner and mobile phone of this petitioner was recovered from the place of occurrence. Petitioner has got one criminal antecedent.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No stolen

Patna High Court CR. MISC. No.59541 of 2025(2) dt.03-09-2025 2/2 article has been recovered from conscious possession of the petitioner. Petitioner has been made accused in this case only on suspicion.

5. Considering the nature of accusation and criminal antecedent, prayer for anticipatory bail of the petitioner is refused.
