The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 of the Indian Penal Code and Sections 47, 47(a), 48(2), 57(1) of the Bihar Excise Amendment Act.
Foreign liquor was recovered from a vehicle on 16.08.2016 by the police. Allegation is that the petitioner was owner of the said vehicle and he had fled away. Submission of the petitioner is that possession of foreign liquor on the alleged date of occurrence was not an offence. Moreover, the petitioner has got no criminal antecedent and he had no knowledge that the said vehicle was carrying liquor. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on
Patna High Court Cr.Misc. No.49378 of 2016 (2) dt.09-12-2016 furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran/Successor Court in connection with Chhapra Muffasil P.S. Case No. 288 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
