It is submitted by learned counsel for the State that without exhausting the remedy of appeal provided under the Bihar Government Servants (Classification, Control and Appeal) Rules, 2005 the petitioner has approached this Court directly by filing the writ petition. He submits that the petitioner has caused substantive delay in completion of the proceeding and thereafter when punishment order has been passed he rushed to this Court without availing the efficacious remedy of appeal under the Bihar CCA Rules, 2005.
