The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 08.06.2020, charge-sheet has been submitted in the case and has antecedent of six cases. Learned counsel for the petitioner submits that the informant alleges that four accused persons intercepted him and looted his purse, mobile and cash and also injured him by butt of the gun.
Learned counsel for the petitioner submits that the F.I.R. was against unknown and the name of this petitioner
Patna High Court CR. MISC. No.68788 of 2021(2) dt.21-04-2022 2/2 transpired in the confessional statement of co-accused which has no evidentiary value. It is further submitted that petitioner was never put on T.I.P. nor any incriminating article was recovered from his possession and he came to be implicated merely because of his antecedents.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 08.06.2020, charge-sheet has been submitted in the case, he was not put on T.I.P. and no incriminating article was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sahebganj P.S. Case No. 154 of 2020 with a condition that one of the bailors of the petitioner shall be his father, Mofij Miyan. (Satyavrat Verma, J) Rishi/- U T
