This is a petition for grant of regular bail for offence under Sections 25(1-B)A, 26 and 35 of the Arms Act. A country made pistol was recovered from the possession of co-accused, Noor Hussain @ Babu. On the confession of Noor Hussain @ Babu, name of the petitioner transpired and Noor Hussain @ Babu has already been allowed regular bail by this Court on 04.08.2016 in Cr. Misc. No. 30100 of 2016. Submission of the petitioner is that there is no other material or criminal antecedent against the petitioner save and except the confessional statement of the co-accused before the police.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Patory (Mohanpur O.P.) P.S. Case No. 113 of 2016 to the satisfaction of the Chief Judicial Magistrate, Samastipur, or successor Court.
