JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in connection with Didargang P.S. Case No. 170 of 2016 registered under Sections 379/461 of the Indian Penal Code pending in the Court of learned Judicial Magistrate, Patna City.

Learned counsel for the petitioners submits that the petitioners are innocent and not named in the FIR and alos no incriminating material has been recovered from the possession of the petitioners save and accept mobile which they have purchased from the shop. Copy of the bill is annexed as Annexure 2 and 2/A to the petition. Petitioners name have come only on the confessional statement of the co-accused and they are in custody

Patna High Court Cr.Misc. No.49836 of 2016 (3) dt.09-02-2017 2/2 since 08.09.2016.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioners.

Considering the facts and circumstances of the case, the petitioners, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Patna in connection with Didarganj P.S. Case No. 170 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
