JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-07-2018 This is yet another case in which the grievance of the petitioner is that despite there being a police report saying that vehicle in question has not been found involved in any case, the learned Court below has not passed appropriate order seeking release of the vehicle. It seems to be unfortunate situation as this Court is being burdened with such kind of applications because of delay in disposal of applications in the Court below. Learned counsel for the State is present.
In the facts and circumstances of the case, the learned Court below is directed to pass an appropriate order of release of the vehicle in question within a period of 15 days from
Patna High Court Cr. WJC No.1608 of 2018 (2) dt.25-07-2018 the date of receipt/production of a copy of this order. Let this order be brought to the notice of the learned District and Sessions Judge, Gopalganj, to find out that how many such petty applications for release of vehicles are pending in the Civil Court at Gopalganj and despite receipt of the police reports why those applications are not being disposed of, the learned District and Sessions Judge, Gopalganj, shall take remedial measures in order to mitigate the harassment of the genuine persons who are waiting for disposal of their applications. The writ applications stands disposed off.
