ANJANA MISHRA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Araria P.S. Case No. 317 of 2015 for the offences registered under Sections 465, 466, 467, 468, 470, 406, 471, 420/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is wholly unfounded and is based on mere speculation. The main accused in the present case is one Shree Kant Singh, who is said to have been taking interview of unemployed persons for providing them job. The main allegation is squarely based against the said Shree Kant Singh for having taken money for giving them job. So far as the present petitioner is concerned, the only allegation against him is that when the said Shree Kant Singh was arrested, he took the name of the present petitioner.

Patna High Court Cr.Misc. No.15380 of 2016 (3) dt.24-06-2016 Learned counsel for the State after perusal of the case dairy, submits that there is no further material in the case dairy, save and except the bald allegation against the petitioner made by the co-accused Shree Kant Singh.

In view of the aforesaid facts and circumstances of the case and the vague nature of allegation as also the fact that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 317 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Jagdish/- U T
