JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks pre-arrest bail in connection with Hisua P.S. Case No.134 of 2017 registered under Section 376 of the Indian Penal Code (for short 'the IPC').

It is submitted by the learned counsel for the petitioner that from perusal of the first information report it would be evident that the informant, a grown up lady, was having extra marital relationship with the petitioner and after having relationship about three years, has instituted the present case under Section 376 of the IPC.

On the other hand, learned counsel for the informant State has submitted that the victim has categorically stated in her

Patna High Court Cr.Misc. No.41994 of 2017 (2) dt.21-09-2017 2/2 statement under Section 164 of the Code of Criminal Procedure that because of relationship with the petitioner her husband did not like and due to relationship with the petitioner she became pregnant.

I have heard learned counsel for parties and perused the record.

Considering the nature of allegation made in the FIR as well as other facts and circumstance of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Hisua P.S. Case No.134 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks.
