03-07-2015 Heard Sri Bindhya Keshri Kumar, learned senior counsel, who was assisted by Sri Neeraj Kumar @ Sanidh and learned A.C. to learned Advocate General.
In the present writ petition, the order of Additional Collector was assailed on the ground that the Additional Collector was not authorized under Section 16 of the Bihar Tenants' Holdings (Maintenance of Records) Act, 1973 to exercise power of revision. This matter has already been set at rest by a Division
Patna High Court CWJC No.11756 of 2011 (4) dt.03-07-2015 2/2 Bench of this Court, reported in 2011 (3) PLJR 422 (Amarendra Kumar Singh vs. The State of Bihar & Ors.) and same has been reiterated in the present writ petition by the Division Bench on the question, which was referred by earlier Single Bench of this Court. Since issue has already been set at rest, there is no reason to pass any favourable order.
The writ petition stands disposed of.
