JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Barun P.S. Case No.23 of 2017 registered under Sections 304B and 201/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner is maternal uncle-in-law of the deceased. He submitted that the victim died a natural death after undergoing treatment for long for her serious ailment in the hospital at Lucknow and the husband of the alleged victim and other in-laws tried their best to provide treatment to the victim. It is further contended that the husband of the victim Deepak Singh @ Vicky

Patna High Court Cr.Misc. No.46024 of 2017 (2) dt.04-10-2017 2/2 has already been granted pre-arrest bail by a Bench of this Court vide order dated 19.09.2017 passed in Cr. Misc. No.42295 of 2017. A copy of the order has been produced before the Court. Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner. He submitted that it is a case under Section 304B of the Indian Penal Code and allegation is that within two years of marriage the daughter of the informant died in other than natural circumstance and no information was given to the family members prior to cremation of the body. Having heard the submissions, regard being had to the order dated 19.09.2017 passed in Cr. Misc. No.42295 of 2017, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.

10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No.23 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
