The petitioner, namely, Arvind Kumar @ Arbind Kumar @ Arbind Mahato has filed the present application for his release on bail on the ground of his juvenility which has been rejected vide order dated 16.07.2019 passed in Cr.Appeal No.33 of 2019 arising out of Maharajganj P.S.Case No.63 of 2019.

Learned counsel for the petitioner submits that though Juvenile Justice Board, Siwan has affirmed the juvenility of the petitioner and considering the nature of the offence, the petitioner has not been released on bail. It is further submitted that the name of the petitioner has come merely on the basis of

Patna High Court CR. REV. No.1066 of 2019(4) dt.23-01-2020 2/2 confessional statement made before police by one Sandeep Singh and, therefore, he should be released on bail. It is further submitted that similarly situated co-accused Sandeep Kumar has already been granted bail by a coordinate Bench of this Court in Cr.Misc.No.47103 of 2019 vide order dated 30.07.2019. Considering the fact that the petitioner has already been declared to be a juvenile in conflict with law, let the above named juvenile petitioner, namely, Arvind Kumar @ Arbind Kumar @ Arbind Mahato be released in favour of his mother who shall kept him under proper supervision and control on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Siwan in connection with Maharajganj P.S.Case No.63 of 2019, J.E.No.96 of 2019. The records may be transferred and returned back to the court concerned at the earliest.

The revision application stands disposed of.
