JUSTICE ARVIND SRIVASTAVA ORAL ORDER 31-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Baghaila P.S. Case No. 22 of 2017 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to dirty village politics. There is case and counter case between the parties. As a matter of fact, when the petitioner started demanding his money, the informant has lodged the present false case to put pressure on the petitioner. Petitioner has no criminal antecedent.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation

Patna High Court Cr.Misc. No.34353 of 2017(5) dt.31-10-2017 2/2 against this petitioner of assaulting by the butt of pistol on account of which father of the informant sustained injuries on his head.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
