The petitioner seeks bail in connection with Sessions Trial No.98 of 2017, arising out of Andhramath P.S. Case No.55 of 2013, registered under Sections 302/34 of the Indian Penal Code besides Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that, earlier, the prayer of the petitioner for grant of bail was rejected by this Court on four occasions, lastly, vide order dated 02.01.2019 passed in Criminal Misc. No.58356 of 2018, with a direction to the trial court to conclude the trial of the petitioner within eight months by taking all effective steps with liberty to the petitioner to renew his prayer for bail, if his trial is

Patna High Court CR. MISC. No.55978 of 2019(2) dt.16-10-2019 2/2 not concluded within the aforesaid period. While the period of more than eight months has already elapsed of passing of the aforesaid order dated 02.01.2019 passed in Criminal Misc. No.58356 of 2018 by this Court but the trial of the petitioner has not been concluded as yet. The petitioner is in custody since 01.07.2014.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI, Madhubani, in connection with Sessions Trial No.98 of 2017, arising out of Andharamath P.S. Case No.55 of 2013. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
