====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 30-07-2018 Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner, already in custody, seeks bail in connection with Pipra P.S. Case No.51 of 2018, registered under Sections 414/413/34 of the Indian Penal Code. Allegation in brief is that one Chandan Kumar Paswan, another accused, was apprehended by the police who admitted that he is involved in committing theft of motorcycles and has given names of four persons to whom he has entrusted them for selling the stolen motorcycles. It is alleged that two motorcycles were recovered, one from Pawan Paswan and one from Md. Mozahid and Chotu.

Learned counsel for the petitioner submits that there is no accusation that the petitioner was indulged in

Patna High Court Cr.Misc. No.45574 of 2018(2) dt.30-07-2018 2/2 committing theft. The motorcycle, as per allegation, was given by Chandan Kumar Paswan, however, the recovery is not from the conscious possession of the petitioner and another coaccused, Md. Mozahid was granted bail by a co-ordinate Bench of this Court vide order dated 19.07.2018, passed in Cr. Misc. No.42136 of 2018 and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Chotu Yadav @ Subhash Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 3rd, Supaul in connection with Pipra P.S.
