The petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 15.07.219, he is a person with clean antecedent and charges have been framed and his bail was earlier rejected by order dated 26.08.2020 in Cr. Misc. No.11070 of 2020.

The learned counsel for the petitioner submits that the Court while rejecting his bail had directed the learned Court below to expedite the trial and conclude the same within a period of 1.5 years from the date of normal Court proceeding.

Patna High Court CR. MISC. No.69325 of 2021(2) dt.26-04-2022 2/2 The learned counsel submits that very recently about a month back, charges have been framed not a single witness has been examined and the petitioner has remained in custody for nearly two years and nine months.

The learned A.P.P. for the State opposes the bail application.

Considering the period of custody of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T. Case No.253 of 2021 arising out of Bairagania P. S. Case No.153 of 2019.

However, if the learned Court below comes to a conclusion that the petitioner after his release is trying to delay the trial, then the learned Court below by a reasoned order will forthwith cancel his bail bonds.

The application stands allowed.
