The petitioner is accused in connection with Ladania P.S. Case No. 135 of 2013 registered under sections 395 and 412 of the I.P.C. pending in the Court of J.M., 1st Class, Madhubani. The allegation is of dacoity at the house of the informant by the petitioner and others.
Submission is that petitioner is quite innocent and has committed no offence. It is also submitted that petitioner is not named in the F.I.R. and nothing incriminating has been recovered from his possession.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner has criminal antecedent and there is specific allegation
Patna High Court Cr.Misc. No.49852 of 2016 (3) dt.10-02-2017 2/2 of dacoity against the petitioner in the case diary. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, petitioner may renew his prayer for bail after framing of charge.
