The petitioner seeks anticipatory bail in Bikramganj P.S. Case No.23 of 2017 instituted for the offences under Sections 341, 323, 324, 307, 354A, 379 and 504/34 of the Indian Penal Code.

As per allegation two persons, namely, Ajit Sah and Munna Pandey came in drunken condition and started abusing the victim. In the morning when she went to enquire into the matter and asked why they were creating nuisance whereupon all the accused persons misbehaved with her and assaulted.

Patna High Court Cr.Misc. No.41361 of 2017 (2) dt.06-10-2017 Learned counsel for the petitioner submits that there is a case counter case and victim is tenant. There is no specific allegation the petitioners.

In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass an order on its own merit without being prejudiced by the order passed by this Court.
