The petitioner seeks bail in a case instituted under Sections 324, 307, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The allegation against the petitioner is that he is also involved along with other accused persons in commission of murder in a case of Mantu Sah.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.09.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is Up-
Patna High Court Cr.Misc. No.51188 of 2016 (2) dt.29-11-2016 2/2 mukhiya. Because of some political reason, he has been implicated in the present case. No overt act is alleged against him, as per the F.I.R. itself. The petitioner was not present at the Place of occurrence.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samstipur in connection with Samastipur Muffasil P.S. Case No. 257 of 2016.
