JUSTICE SATYAVRAT VERMA ORAL ORDER 28-09-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. Learned counsel for the informant, at the outset, submits that he is withdrawing his vakalatnama as the informant is not cooperating nor is willing to appear physically before this Court as directed.

Learned counsel for the petitioner submits that when the case was taken up on 26.07.2022, it was submitted that the petitioner is willing to keep the informant as his wife with all dignity and honour as the issue on which the present case came to be instituted was trivial, accordingly

No.69183 of 2021(5) dt.28-09-2022 2/3 the case was fixed for 24.08.2022 when both the petitioner and the informant were directed to remain physically present. on 24.08.2022 when the case was taken up, the petitioner was present along with his counsel but the informant did not appear as such the learned counsel for the informant prayed for time, thereafter the case was again fixed for 28.09.2022. Today again when the matter is taken up, learned counsel for the informant made the submission as aforesaid.

Learned counsel for the petitioner submits that petitioner has shown his willingness to keep his wife with all honour and dignity and the petitioner also realises that the FIR came to be instituted on a very trivial issue but despite indulgence being granted by the Court it appears that the informant is not willing to accompany the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/-

Patna High Court CR. MISC.
