The petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 24.09.2021, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of recovery of one country made pistol along with one live cartridge and one unregistered Apache motorcycle from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, nothing was recovered from his possession and the petitioner

Patna High Court CR. MISC. No.68911 of 2021(2) dt.10-05-2022 2/2 has remained in custody for nearly eight months, it is also submitted that no offence was committed by the petitioner though it is alleged that he was carrying a gun and a stolen motorcycle.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.09.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Madhaura P.S. Case No. 560 of 2021 with a condition that one of the bailors of the petitioner shall be his father, Shatrudhan Singh.
