JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 17-10-2017 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471 and 420/34 of the Indian Penal Code. It is alleged that the informant entered into an agreement with the petitioner for purchase of the land and consequently transfer was made through registered Sale Deed on consideration amount of Rs.5,75,000/- but thereafter the husband and children of the petitioner restrained the informant from completing the construction over the land in question. No.47881 of 2017 (2) dt.17-10-2017 2/2 petitioner that the husband of the petitioner deserted her and subsequently, he protested but the informant admits that the petitioner has executed sale deed. Moreover, husband of the petitioner has filed title suit. Hence, in the background of civil nature of dispute the accusation has been levelled. Considering the nature of accusation and the fact that the petitioner is a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Bihar P.S. Case No. 148 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
