JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Khiri More P.S. Case No. 62 of 2018, registered for the offences punishable under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, dead body of the husband of the informant was found lying in the field on the Machan and she suspected one Pappu Kumar as he was given threatening to him. She also suspected petitioner and other co-accused persons assisted the Pappu Kumar.
Submission of the learned counsel for the petitioner is that except suspicion there is nothing against him and other two accused persons who are also named in the F.I.R have been granted privilege of anticipatory bail vide order dated 02.04.2019 passed in Criminal Miscellaneous No. 19555 of
Patna High Court CR. MISC. No.54582 of 2019(2) dt.30-08-2019 2/2 2019 and vide order dated 25.06.2019 passed in Criminal Miscellaneous No. 19939 of 2019. It has further been submitted that there is enmity between Pappu Kumar and deceased. Heard learned A.P.P. also.
In view of the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, III, Danapur, Patna, in connection with Khiri More P.S. Case No. 62 of 2018, subject to the condition as laid down under Section 438
(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned and he will co-operate in the investigation. (Vinod Kumar Sinha, J) T.Kr./- U T
