Both the above stated petitions have arisen out of Baruraj P.S. Case No. 117 of 2014 registered for the offence
punishable under Section 394 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order.
Heard learned counsels for the petitioners as well as learned Additional Public Prosecutor for the State. In course of investigation, 81 bags of alleged looted betel nuts were recovered from the godown of petitioner in Cr. Misc. No. 48520 of 2014 and the said godown was hired by petitioner in Cr. Misc. No. 48520 of 2014 from petitioner no. 1 of Cr. Misc. No. 50497 of 2014. Admittedly, petitioner no. 2 of Cr. Misc. No. 50497 of 2014 is driver of pick up van. The seized betel nuts have already been released in favour of S.G. Enterprises as the aforesaid farm claims its ownership on the seized betel nuts. It is also an admitted position that petitioner in Cr. Misc. No. 48520 of 2014 also claims himself to be the owner of seized betel nuts but up till now, no order has been passed on the release petition of the petitioner in Cr. Misc. No.
48520 of 2014 by the concerned court. Moreover, petitioners do not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.
each to the satisfaction of Shri Santosh Kumar, Judicial Magistrate 1st Class, Muzaffarpur in connection with Baruraj P.S. Case No. 117 of 2014.
