2. The petitioner has preferred this application for grant of regular bail in connection with Pipariya P.S. Case No. 60/2025 dated 19.06.2025 registered for the offence punishable u/s 103(1) and 61(2)(a) read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, when the informant's husband was returning to home after participating in the last rituals of the father of Ashok Singh. The co-accused persons along with 5-7 unknown miscreants holding weapons fired indiscriminately upon the informant's husband and one Chandan Kumar due to which they died. On hearing the noise of firing,

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the course of investigation. The petitioner is the Manager of Mahadeo Cinema Hall who disclosed that his owner (Golu Babu) told him to arrange the accommodation of four persons in the Cinema Hall and further disclosed that his owner told him to arrange their accommodation in Sangam Hotel. Learned counsel has submitted that there is no active participation of the petitioner in the crime alleged. It is further submitted that the petitioner was not present at the time of alleged occurrence. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.06.2025.

5. Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the bail petition of the petitioner by submitting that it is a case of double murder.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.59934 of 2025(2) dt.10-09-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Pipariya P.S. Case No. 60/2025, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
