The petitioner is apprehending his arrest in connection with Lalganj P.S. Case No. 330 of 2015 for the offences instituted under Sections 147, 148, 149, 353 and 427 of the IPC. The prosecution story, in brief, is that the informant received information that injured Rajendra Chaudhary died in PMCH due to accident in respect to Lalganj P.S.Case No. 329/2015 and the public at large have attacked the house of the driver Md. Rizwan and damaging his property as well as assaulting. The informant went there and tried to convince them but the mob damaged the vehicle which caused accident and also scuffled with the force and after arrival of B.D.O., Lalganj, peace
Patna High Court Cr.Misc. No.51602 of 2016 (2) dt.06-12-2016 2/2 could be restored.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. No specific allegation has been made against him. General and omnibus allegation has been made against him. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Lalganj P.S. Case No. 330/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
