JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-01-2020 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Fulkaha P.S. Case No. 174 of 2018 corresponding to Sessions Trial No. 83 of 2019, registered for the offences punishable under Sections 363, 366, 376, 504 and 34 of the Indian Penal Code.

The informant alleged that all the accused persons including this petitioner kidnapped her daughter-in-law and committed rape with her.

It is submitted that petitioner has falsely been implicated in this case. Petitioner is in custody since 24.10.2018 having clean antecedent.

It appears from the statement of victim under Section 164 Cr.P.C. that this petitioner along with co-accused kidnapped

Patna High Court CR. MISC. No.66257 of 2019(3) dt.24-01-2020 2/2 her and forcibly committed rape upon her.

In view of the statement of victim under Section 164 Cr.P.C, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
