Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 414 of 34 of the Indian Penal Code.
Allegation against petitioner is that during motorcycle checking by the police, petitioner was apprehended with a stolen motorcycle.
It has been submitted on behalf of petitioner that he is in custody since 14.4.2016. Chargesheet has been submitted against petitioner. He has falsely been implicated in the present case. No allegation of tampering of witnesses is alleged against petitioner. Petitioner had no knowledge that the motorcycle in question was a stolen property.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.51194 of 2016 (2) dt.05-12-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Phulwarisharif P.S. Case no. 220 of 2016.
