JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 This application, for grant of anticipatory bail, arises out of Palasi P.S. Case No. 188 of 2016, disclosing offences under Sections 323, 379, 406, 420, 504, 467, 468 and 120(B) of the Indian Penal Code.

Prosecution case as per complaint petition on the basis of which, F.I.R has been instituted is to the effect that informant purchased a piece of land from the co-accused persons bearing Khata No. 54, Plot No. 584, in which these petitioners were witness, however, the accused persons fraudulently sold the land pertaining to Plot No. 583 in place of Plot No. 584 and when the informant went to demand his money, accused persons abused him.

No.58666 of 2019(2) dt.17-09-2019 2/2 Submission of learned counsel for the petitioners is that now the correction has already been done in the sale deed and parties have also compromized the matter, which will appear from Annexure -2. Moreover, these petitioners were only the witness on sale deed.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 188 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
