Mr. SRI RAM ANURAG SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 24-01-2018 Heard the learned counsel for the petitioner and the State.
The petitioner apprehends his arrest in Ram Krishna Nagar P.S. Case No. 181 of 2017 instituted for the offence under Sections 147, 148, 149, 323, 341, 353, 307 and 504 of the Indian Penal Code.
Counsel for the petitioner submits that there is no any allegation against the petitioner. He is implicated in the case only because of involvement of his brother Dabloo Yadav in the case.
In the written report it is alleged that the police had gone to arrest said Dabloo Yadav and in the meantime the petitioner and other accused persons armed with Farsa
Patna High Court Cr.Misc. No.40792 of 2017(5) dt.24-01-2018 2/3 and Gadasa attacked the police party while Dabloo Yadav managed to run away from the house.
Counsel for the State submitted that the petitioner has criminal antecedents and 12 cases are pending against him.
The counsel for petitioner has submitted that petitioner is on bail in all these cases. It has further been submitted that co-accused Dabloo Yadav @ Dabloo Kumar has already been granted anticipatory bail by a coordinate bench of this Court by order dated 12.01.2018 passed in Cr. Misc. No. 41752 of 2017.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Ram Krishna Nagar P.S. Case No. 181 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub- JudgeVIII, Patna, subject to the conditions (1) bailor should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall
