The petitioner apprehends his arrest in connection with Khaira P.S. Case No. 304 of 2022 registered under Sections 341, 323, 324, 354(A), 379, 307, 504 and 34 of the I.P.C. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. Petitioner has no criminal antecedent. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report. Further he submits that from perusal of first information report itself, it is apparent that there is direct allegation against the petitioner of

Patna High Court CR. MISC. No.62285 of 2022(2) dt.11-04-2023 2/2 assault by means of sword on the head of the mother of the informant with intention to kill her. Hence, this is not a fit case for anticipatory bail.

Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner.
