JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Laxmipur P.S. Case No. 50 of 2022, registered for offence punishable under section 302/34 of the Indian Penal Code. The deceased Rajodas is husband of the petitioner. The informant of this case is Chowkidar. A dead body was lying in the house of Dhiba Das. The Chowkidar got information from the villagers that Dhiba Das, who is father-in-law of the deceased and the petitioner, wife of the deceased, committed murder of the deceased and fled away from their house. The learned counsel for the petitioner has submitted that the petitioner is innocent. During the course of

Patna High Court CR. MISC. No.62589 of 2022(3) dt.24-03-2023 2/3 investigation, it was detected that the petitioner has solemnized love marriage with the deceased and her father was annoyed with that marriage. It is not possible for the wife, who had solemnized love marriage, that she may kill her husband. On the other hand, the learned APP has opposed the prayer for bail.

The FIR shows itself that prior to the occurrence, some altercation had taken place between the deceased and his father-in-law, Dhiba Das. There is nothing which shows that the deceased was inimical to the petitioner. The petitioner is under custody since 06.05.2022 and she is a lady of clean antecedent. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui in connection with Laxmipur P.S. Case No. 50 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the
