JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 25(1-b)A/26/35 of the Arms Act.

On search of the motorcycle, one country-made loaded pistol was recovered from the possession of the person, who was driving the motorcycle i.e., Bikram Kumar. The petitioner and co-accused Prince Kumar was back rider. Prince Kumar has been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.48944 of 2016 on 08.12.2016 and petitioner is in custody since 12.09.2016.

Considering the facts aforesaid, let petitioner,

Patna High Court Cr.Misc. No.50474 of 2016 (2) dt.22-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/Successor Court, in connection with Mansi P.S. Case No.172 of 2016.
