Learned counsel appearing on behalf of the petitioner submitted that the matter has been compromised between the parties in the terms of settlement mutually agreed upon out of agreement dated 25.04.2023 as reported by mediator Mr. Yogendra Prasad. It appears from said agreement that total amount of Rs. 5,50,000/- (Rupees Five Lakhs Fifty Thousand only) as full and final settlement to be paid to the Opposite Party No. 2, namely, Jinat Khatoon @ Zeenat Khatoon by 10th of June, 2023 through Bank Draft.

The petitioner also agreed to return the goods

Patna High Court CR. MISC. No.57743 of 2022(5) dt.03-05-2023 2/3 (articles) belonging to Opposite Party No. 2. Learned counsel appearing on behalf of the informant also appears in agreement with aforesaid discussed terms and conditions as settled through Mediation Report dated 25.04.2023.

In view of the aforesaid facts and circumstances, as matter has been compromised between the parties in terms of agreement dated 25.04.2023 as reported by Mediation Centre of Patna High Court, the above named petitioner, in the event of his arrest or surrender before the Court below, within a period of four weeks of this order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge III-cum-Additional Chief Judicial Magistrate-II, Vaishali at Hajipur/concerned Court, where the case is pending in connection with Complaint Case No. 1527 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Learned trial Court is directed to ensure the agreement dated 25.04.2023 in its true spirit, without delay. Petitioner is directed to furnish the copy of agreement dated 25.04.2023 as executed between the parties while
