In this case, a limited grievance has been raised by the petitioners to extend the cut-off date i.e. 1.1.2018 sometime in the month of June on the day the notification has been published for recruitment of Constable.
The petitioners are the trained Home Guards, their training has been completed on 1.4.2018 and the Commission has issued
Patna High Court CWJC No.11982 of 2018 dt.31-07-2018 2/2 notification for recruitment of Constable fixing the percentage of seats for Home Guards.
Learned counsel for the petitioners submits that the notification has been published on 25.5.2018 and the cut-off date has been fixed on 30.6.2018. He further submits that they have completed their training as on 1.4.2018, as the cut-off date has been fixed as on 1.1.2018, they have been deprived of participation in the selection process.
Fixation of cut-off date is decided by the executive or selecting agency and the prayer for shifting the cut-off date cannot be changed by the Court as the cut-off date is fixed taking into consideration several aspects of the matter. However, the petitioners have filed representation to the Director General of Police, Patna. In that view of the matter, the Director General of Police, Patna is requested to consider the representation of the petitioners and take a decision in accordance with law within a period of three months from the date of receipt/production of a copy of this order. With the aforementioned observation and direction, this writ application is disposed of.
