JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kadam Kuan P.S. Case No. 230 of 2016 registered under Sections 498A, 406, 302, 201 and 120B/34 of the Indian Penal Code.

The accusation is of torture for non-fulfillment of demand of dowry and thereafter, the informant was ousted from her matrimonial house and also given threatening to kill. Learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated in this case. It is also submitted that the husband of the complainant

Patna High Court Cr.Misc. No.50593 of 2016 (4) dt.08-02-2017 2/2 disappeared from 7 years, for which a complaint case was filed by her on 01.06.2016, i.e. after lapse of very long period, which was forwarded for institution of the case vide Kadamkuan P.S. Case No. 230 of 2016. On perusal of order of the S.D.M.-cum-Public Grievance Redressal Forum (Annexure-2), it appears that the conduct of the complainant was doubtful even then her mother-inlaw was ready to keep her in her house without any other person and also nearby people told the allegation levelled against the inlaws' family is baseless.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Patna in connection with Kadamkuan P.S. Case No. 230 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
