The petitioner seeks bail in a case registered under Sections 307, 324, 341, 323, 504/34 of the Indian Penal Code. Later on, Section 302 of I.P.C. has been added. Allegation is that while the informant was washing his Bolero jeep, the accused persons including the petitioner came there and forbidden him from washing the vehicle. In the meantime the father of the petitioner, namely, Shivnand came there and interfered, then Suchit Bind came with garasa and gave blow on the head of informant's father, who sustained head injury and was taken to the Hospital for treatment and then he was referred to Trauma Centre, Varanasi for treatment. In course of treatment, informant's father died.
Patna High Court CR. MISC. No.54658 of 2019(2) dt.30-08-2019 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.7.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation of assault is alleged against co-accused Suchit Bind. The case was instituted for an offence under Section 307 of I.P.C. Later on, Section 302 of I.P.C. has been added. The deceased is said to have died after four days of occurrence in course of treatment. The petitioner is said to be member of unlawful assembly.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Durgawati P.S. case No.98 of 2019, G.R.
