It has been submitted that the petitioner was granted bail by this court vide order dated 17-07-2017 passed in Cr. Misc. No. 31525 of 2017. In the first paragraph and prayer portion of original bail petition, learned Judicial Magistrate-Ist Class, Patna" in place of "learned Judicial Magistrate-Ist Class, Patna City" has been mentioned inadvertently. Consequently, the same mistake occurred in the order dated 17-07-2017 passed in Cr. Misc. No. 31525 of 2017.
Counsel for the petitioner is permitted to make necessary correction in the first paragraph and prayer portion of original bail petition of Cr. Misc. No. 31525 of 2017 in course of the day. This modification application is allowed to the extent that word, learned Judicial Magistrate-Ist Class, Patna" mentioned in
Patna High Court Cr.Misc. No.38523 of 2017 (2) dt.23-08-2017 the order dated 17-07-2017 passed in Cr. Misc. No. 31525 of 2017 be read as "learned Judicial Magistrate-Ist Class, Patna City". The time for surrender of the petitioner in the court below is extended for further three weeks from the date of receipt of this order. In the event, the petitioner surrenders in the court below within aforesaid period, he shall be released on anticipatory bail on same terms and conditions as mentioned in the order dated 17-07-2017 passed in Cr. Misc. No. 31525 of 2017. It is made clear that no further extension of time will be allowed.
