The petitioner wants to renew the prayer of bail, which was earlier rejected by order dated 28.03.2016 passed in Cri. Misc. No. 4286 of 2016 on the ground that the petitioner is not named in the First Information Report, his age does not tally with the description given in the First Information Report and without any fault he is suffering in custody since 26.08.2015 and as such the petitioner deserves sympathetic consideration. Learned A.P.P. opposes the prayer of bail by submitting that the informant in his further statement has stated the name of the petitioner that he is the assailant. In the facts and circumstances stated above, finding no
Patna High Court Cr.Misc. No.50360 of 2016 (2) dt.30-11-2016 2/2 good ground for reconsideration of prayer of the bail, again the prayer of the bail of the petitioner stands rejected. However, let the trial be expedited and concluded as early as possible preferably within 6 months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may be at liberty to renew his prayer for bail.
