JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code.

The accusation is to the effect that, the petitioner being a labour mate, used a JCB Machine for digging a Pokhar (pond) rather than engaging manual labours. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The scheme was to be supervised by the different authorities but none have made any complaint with regard to the same. A statement has been made in paragraph 3 of the petition

Patna High Court Cr.Misc. No.47880 of 2017 (2) dt.18-10-2017 2/2 that the petitioner is having no criminal antecedent. Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Darbhanga in connection with Simri P.S.
