The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 363, 364A of the Indian Penal Code.

Prosecution case is that the informant namely Yogeshwar Prasad has given written report before the S.H.O. Dehri(T) alleging therein that his son namely Gopal Kumar along with his friend Dhananjay Singh went attending the marriage ceremony by the private car on 01.03.2016 and further stated that will be return at night but till date his son was not returned and their mobile is switched off.

Learned counsel for the petitioner submits that the petitioner is innocent, has not committed any offence and has

He further submits that petitioner has one criminal antecedent i.e. Chainpur P.S. Case No. 204 of 2015 under Sections 147, 149, 353, 332, 333, 336, 337, 427, 436, 504 of the I.P.C.

Considering the fact that till date victim boy is traceless, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his payer for anticipatory bail is rejected in connection with Dehri (T) P.S. Case No. 120 of 2016 corresponding to G.R. No. 226 of 2016 pending before the court of the learned S.D.J.M., Dehri, Rohtas.

Accordingly, the application is dismissed.
