The petitioner seeks bail in connection with Purnea Sadar P.S. Case No. 480 of 2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 17.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 80.41 litres of liquor from house of the petitioner.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.68935 of 2021(2) dt.25-02-2022 2/2 house from where the alleged recovery of liquor has been made is a joint family property and as such the petitioner was not knowing who had kept the liquor in the house. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 17.09.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Purnea in connection with Purnea Sadar P.S.
