The petitioner seeks bail in connection with Nalanda P.S. Case No. 04 of 2019, registered under Sections 363, 365, 363 and 302 of the Indian Penal Code. Learned counsel for the petitioner submits that it would appear from the F.I.R. that in course of investigation, on suspicion, the Police apprehended Anil Kewat, husband of petitioner, and got recorded his confessional statement to the effect that he and his wife (petitioner) committed murder of Sagar Kumar, son of the informant Mamta Devi, due to his love affairs with the petitioner and on that very basis, the dead body was also recovered.Further submission is that, in fact, the confessional statement of petitioner was not recorded, rather,

No.56624 of 2019(5) dt.18-12-2019 2/2 on the confessional statement of her husband Anil Kewat, the dead body was recovered, but petitioner has falsely been implicated in this case due to love affairs of the petitioner with the deceased as stated by the husband of the petitioner. Further submission is that petitioner, who is lady, has not criminal antecedent and she is in custody since 07.03.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 04 of 2019.
