2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with Basantpur (Lakdinabiganj O.P.) P.S. Case No. 288 of 2021 registered for the offence under Sections 363, 366, 34 of the Indian Penal Code.

4. As per the prosecution case, the petitioner is accused of kidnapping two married women and one child.

5. Learned counsel for the petitioner submits that the petitioner is innocent and the statement of the victim girls made under Section 164 of the Cr.P.C., it appears that the petitioner has taken the kidnapped persons to Surat and kept them in a room and after the lodging of the case the petitioner left them on Gorakhpur Station.

6. Learned counsel for the petitioner further submits

Patna High Court CR. MISC. No.59499 of 2023(3) dt.08-11-2023 2/2 that it is very difficult to believe that one person single-handedly took away two married women and a child to Surat and then to Gorakhpur.

7. Learned counsel for the petitioner also submits that the petitioner is in custody since 08.02.2023.

8. Learned A.P.P. has vehemently opposed the prayer for bail.

9. It appears that the victims might have eloped with the petitioner.

10. Considering the aforesaid facts, this application for regular bail is allowed.

11. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Basantpur (Lakdinabiganj O.P.) P.S. Case No. 288 of 2021.

12. After being released on bail, the petitioner is directed to co-operate in the trial by appearing in the Court below on every date either himself or through his lawyer. (Sandeep Kumar, J) Vikas/- U T
