The petitioner seeks bail in a case instituted for the offence under Sections 394, 302 of the Indian Penal Code. It has been submitted that petitioner is not named in the First Information Report. His name has come in para-67 of the case diary during investigation. The police have stated that he learnt about involvement of the petitioner from spy. The police have further stated that petitioner's name has come on the confessional statement of co-accused.

Learned APP has not controverted such submission as raised by the counsel for the petitioner.

From the fardbeyan, it appears that name of this

Patna High Court Cr.Misc. No.53004 of 2016 (3) dt.27-01-2017 2/2 petitioner is not mentioned there. The case has been registered against unknown. Petitioner is said to be in custody since 18.07.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Mohania P.S.
