Mr. SRI KHURSHID ANWAR ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 21-09-2017 Heard both sides.

Apprehending his arrest in Mohania P.S. Case No. 414 of 2016 registered under section 302/34 IPC, the petitioner has prayed for anticipatory bail.

It is stated that he is named in the FIR merely on the basis of suspicion as the deceased had kidnapped the married sister of the petitioner. A complaint was also lodged by the family members Anju Devi in connection therewith. Counsel for the State, on the other hand, submits that there was strong motive for the petitioner to commit the crime particularly when the FIR itself alleges that threatenings were continuously held out by the petitioner to the family of the deceased. It is also stated that in course of investigation, the

Patna High Court Cr.Misc. No.46573 of 2017(2) dt.21-09-2017 2/2 complicity of the petitioner has surfaced.

In my view, it is not a fit case for grant of anticipatory bail. Prayer is rejected.
