JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sono P.S. Case no. 39 of 2009, registered under Sections 302, 201 and 120-B of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that Complaint Case No. 255 (C) of 2009 was lodged by the informant against her father-in-law and brother-in-law and other family members to commit murder of her husband Shankar Yadav. The petitioner is not named in the F.I.R. In course of investigation in supervision note of Dy.S.P. suspicion has been raised against the petitioner, Bhim Yadav and Tuphani Yadav having hand in the murder of husband of the informant due to illicit relation with the informant, except the suspicion, nothing has been collected by the I.O to show his involvement. The petitioner has no criminal antecedent and similarly

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Jamui in connection with Sono P.S. Case No. 39 of 2009, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
