2. The petitioner apprehends arrest in connection with Muffasil P.S. Case No. 676 of 2023 dated 20.06.2023, instituted for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. The allegation is of recovery of seven litres local Mahua liquor from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he is falsely implicated in this case. It is further submitted that nothing has been seized from the conscious possession of the petitioner and the house in question does not belong to the petitioner. Lastly, it has been submitted that the petitioner has one criminal case against him.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Since the seven litres illicit local Mahua liquor has been recovered from the house of petitioner, I am not inclined to grant the anticipatory bail to the petitioner.

7. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
