The petitioner seeks regular bail in connection with Sessions Trial No. 82 of 2020, arising out of Sikandra Police Station Case No. 222 of 2018, registered for the offences punishable under Sections 342/364-A/120-B/34 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that the minor son of the informant was abducted by two motorcycle borne criminals and later on, the victim boy was recovered from the custody of co-accused Praduman Kumar. Learned Counsel for the petitioner submits that the name of the petitioner transpired on the basis of confessional

He further submits that the self-inculpatory statement of the petitioner was also recorded by the police. He next submits that the victim boy has not identified the petitioner. He further submits that co-accused persons, namely, Vijay Mahto (vide, order dated 28.08.2019, passed in Criminal Misc. No. 35741 of 2019), Ajay Yadav (vide, order dated 27.08.2019, passed in Criminal Misc. No. 42433 of 2019), Rahul Kumar (vide, order dated 27.09.2019, passed in Criminal Misc. No. 42975 of 2019), Praduman Kumar (vide, order dated 21.10.2020, passed in Criminal Misc. No. 17439 of 2020) and Pravin Yadav (vide, order dated 10.06.2020, passed in Criminal Misc. No.

17460 of 2020), have been granted regular bail by different co-ordinate Benches of this Court. He further submits that the petitioner is in custody since 25.02.2019. Regards being had to the submissions made on behalf of the parties and taking into consideration the materials on record and the fact that similarly situated co-accused persons have been granted bail by this Court and the petitioner is in custody since 25.02.2019, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.
